Hire of Toys Agreement

For the purpose of these Terms & Conditions 'the Hirer' is defined as the person or persons hiring the item or items from Party Kidz Toy Hire and Sales.

The Hirer must sign the “Hire of Toys Agreement” (which incorporates these Terms & Conditions) at the time of delivery or booking. The Hire of Toys Agreement will indicate the hire period, including the start and finish dates, acceptance of instruction for the safe use of the hire equipment and acceptance that the Hirer has read, understood and agreed to all of the stated toy hire Terms & Conditions of Party Kidz Toy Hire and Sales. No hire will be entered into without the signing of this agreement.

Bookings:

Please complete the booking form and email it to inquiries@partykidz.com.au and one of our team members will contact you to confirm booking details with you.

Hire Basis:

Our toy hire is based upon a 5 day hire (or other duration upon availability). Toys will be delivered and collected on the day requested and in the 3 hour time frame requested (upon availability).

The items supplied for hire by Party Kidz Toy Hire and Sales will remain the exclusive property of Party Kidz Toy Hire and Sales and the Hirer or will not lend, sell, or underlet any items supplied for hire. The Hirer is not to remove the items from the nominated delivery address unless prior written approval is obtained from Party Kidz Toy Hire and Sales.

Pricing:

All prices quoted on the Party Kidz Toy Hire and Sales website and on the Hire of Toys Agreement are inclusive of GST and we reserve the right to amend prices at any time without notice.

This Hire of Toys Agreement constitutes the entire agreement of the parties with respect to its subject matter and supersedes all prior agreements and understandings between the parties in connection with it.

Payment:

Payment can be made by credit card a 30% deposit must be received upon approval of your booking and paid for in full 5 days prior to delivery.

Security Deposits:

A security deposit of $100 will be required against the loss and damage to the products. Some wear and tear is expected and this will be allowed for. The security deposit may be used to cover the cost of inappropriate damage resulting from the hire.  Any use of your security deposit will be advised to you either by email or over the phone.

The Hirer accepts responsibility to return the items in the same state of repair and cleanliness as when delivered. The Hirer shall be responsible and indemnifies Party Kidz Toy Hire and Sales against any loss or damage to the hire items. In the event of a loss or theft of the items supplied, the Hirer must immediately notify Party Kidz Toy Hire and Sales and the Hirer will be responsible for the replacement value of the item or items.

Delivery/Collection:

When your event is booked within our service area we deliver and remove equipment Monday to Friday. Party Kidz Toy Hire and Sales will set up and pack up the play equipment, this service is covered by the delivery fee. Set up time is approximately between 5 to 20 minutes per product depending on toys hired. Delivery on a Saturday, Sunday or Public Holiday is subject to availability and will incur an additional charge.

Cancellations:

A booking cancellation may be made no less than 10 days of the event time and will forfeit 50% of booking fee. Cancellations made with less than 10 days will forfeit the entire amount paid.

Insurance, Liability, and Responsibility

Party Kidz Toy Hire and Sales is insured for limited public liability.  We do not assume responsibility for or in any way guarantee your event.  Hirers should seek their own cover and assume their own responsibility for their event.  It remains the hirer’s responsibility to address all event OH&S matters.

The Hirer or their nominated carer agrees to only use the item or items hired for their intended use and only in accordance with the instructions provided.

It is the sole responsibility of the Hirer to ensure that the items hired are suitable for the age and skills of the children who will use them.

To the extent permitted by law, Party Kidz Toy Hire and Sales shall not be liable and the Hirer or their nominated carer hereby releases Party Kidz Toy Hire and Sales from any loss or damage howsoever arising (whether arising under statute, from negligence, personal injury, death, property damage, or infringement of third party rights or otherwise). Party Kidz Toy Hire and Sales does not accept any liability as a result of a failure to comply with specific instructions and under no circumstances will Party Kidz Toy Hire and Sales be held liable for any injury caused by or arising from items supplied. The Hirer must ensure that any or all children using any equipment supplied by Party Kidz Toy Hire and Sales are supervised by a competent person at all times.

In the event of loss or theft of the items hired, the Hirer must provide a police report in the case of theft and a signed statement in the case of loss.

Age Limit:

Most of our equipment is suitable for children up to 7 years of age and some even cater for adults.  It is the sole responsibility of the Hirer to ensure that the items hired are suitable for the age and skills of the children who will use them.  All hire must have proper adult supervision at all times.

Children Supervision:

Young children must be supervised by an adult at all times when playing with the equipment. NO responsibility will be taken for any accidents caused as a result of negligence when playing with this equipment.  Safety matting is supplied upon request. The Hirer must ensure that any or all children using any equipment supplied by Party Kidz Toy Hire and Sales are supervised by a competent person at all times.

Your Privacy:

Party Kidz Toy Hire and Sales collects and retains in its database personal information gathered from our website, fax, or shopping centre displays for the purpose of advising of new products, services and special offers.

It is our intention to maintain your privacy at all times. If at any such time you wish to withdraw from our database, please contact us and we will have your name removed. Party Kidz Toy Hire and Sales do not use telemarketers in any campaign and will not ask for credit card details except for hire purposes.
